Terms of Use



Elite Chauffeurs Inc (the "Company”)provides transportation services (the “Services”) in the state of Florida (the "State"). By using this Site and/or the Services of the Company, you are agreeing to all the terms and conditions contained in these Terms of Use (the “Agreement”) and our Privacy Policy, which is included within. If you do not agree with the terms and conditions contained in this Agreement, your only recourse is not to use this Site (other than for the first time to read this Agreement) or the Services. the Company offers personalized service, including door-to-door transportation from local airports to your hotel and, with advance notice, can include additional stops for all of your necessities to make your time in the State memorable, including, but not limited to, grocery, liquor store, and ski rentals.

Family Travel

If you are traveling with children under the age of 18, the Company requires that all children have a car seat, booster seat, or seatbelt that complies with the State laws. For children under the age of 1 and those under 3 who weigh less than 20 pounds, a rear-facing child seat is required. For children over the age of 1 but under 3 years old who weigh more than 20 pounds, a rear-facing or forward-facing car seat is required. For those who are between 1 and 3 years of age and who weigh more than 40 pounds or those between the ages of 3 and 7 years old, but who weigh less than 40 pounds, a forward-facing car seat or booster seat is required. For those between the ages of 3 and 7 years old but who weigh greater than 40 pounds, a forward- facing car seat or booster seat is required. For those children between 8 and 17 years old who weigh 40 pounds or less, a forward-facing care seat or booster is required. For those who are over 8 years old but less than 18 years old but weigh more than 40 pounds, a forward-facing booster seat or seatbelt can be used.

You are welcome to use your own child safety devices at any time. If you are in need of child safety devices to use as part of the Services, please notify the Company at least seven days in advance of your travel date. Due to space limitations, the Company only carries child safety devices upon request. Failure to notify the Company about your need for child safety devices may result in your trip being cancelled if child seats are not available upon pickup. All Services that are cancelled due to failure to request child safety devices in advance will result in the total fee for the Services being billed to you. Child Safety Devices rental will be charged at the rate of $10.00 per device per trip and may only be used with the Company’s vehicles.

Seatbelts

All passengers under the age of 8 must be in the proper child safety restraint device (car seat or booster seat). All passengers ages 8 through 18 must wear a seatbelt unless another device is required by law. All passengers who sit in the front seat must wear a seatbelt as required under the State law. For those over 18 who sit in the backseats, you may be required to wear a seatbelt if requested by your driver. For all mountain travel and during severe weather, the Company requires all passengers wear seatbelts and/or use appropriate child safety devices. Failure to wear seatbelts as required under the State law or by request of your drive will result in the Services being cancelled and the total amount of the Services requested being billed to you.

Cargo

When booking, you must state the number of passengers that will be using the Service. If you are traveling with skis, snowboards, fishing equipment, other recreational equipment, or more than one piece of luggage per passenger, please note this in your reservation. A representative will call you to discuss your travel needs as the size of the vehicles will limit the capacity available for people and/or luggage. For example, if you are traveling with a large group, there will be less room for luggage in the vehicle.

Damage to Vehicles

You agree and acknowledge that you are responsible for all damage done to our vehicles by you or your guests, including, but not limited to, cleaning fees. You agree and acknowledge that all vehicles are non-smoking and, at the discretion of the driver, may not allow food or beverage consumption in the vehicle. You agree to pay for all damage caused due to any reason, including, but not limited to, paint damage, torn upholstery, car sickness, excess smells, broken doorknobs and handles, scratches, and other excessive dirt. All cleaning fees may be billed to the credit card on file. You agree an acknowledge that in addition to the cost of cleaning/repair, you may also be billed for all time that a vehicle is out of services or, if available, the costs to outsource any trips with the use of another vehicle.

Reservations

You must be over the age of 18 to make a reservation online and have a valid credit card. All travelers under the age of 18 must be accompanied by an individual over the age of 18 who is the parent or legal guardian of at least one of the minors. Drivers may refuse service to any group that appears to be under the age of 18 or does not have a parent or legal guardian present. Online reservations are not final until you receive confirmation of reservation from the Company. You will receive an invoice by email only once reservation is finalized. the Company reserves the right to reject any online reservations at any time. There is no guarantee of any reservation until payment is received and accepted by the Companys. Airline details are required at the time of reservation including the arrival airport, airline information, flight number, estimated time of arrival, and estimated time of departure. Any stops except for your arrival and destination, such as grocery and liquor store stops, must be prearranged seven days prior to arrival and will be charged accordingly. Reserved time will be charged the full fee except as stated in the cancellation section even if you do not use the vehicle.

Please note, unless requested and agreed to in advance, hourly extended time may not be available for all trips and grocery, liquor store, or other stops may be time limited based upon your reservation. If you do not show up for a pickup for any reason, you will not receive a refund.

ON-TIME SERVICE GUARANTEE

If your reservation is confirmed and paid in full more than three days prior to pick-up, the Company guarantees on-time pick-up with the exception of weather-related delays, traffic delays, acts of God or nature, or unforeseen mechanical occurrences. You will be notified by phone if your driver will be late for pick-up.

GRATUITY

Gratuity is not included in your fare. A minimum gratuity charge of 15% will be added to each trip total. If you wish to add more, let us know during booking confirmation. Your driver can also accept cash at the time of the Services.

SMOKING/DRUG POLICY

There is no smoking of any kind or use of any illicit substance in any of our vehicles. This is a company policy that is not determined by your driver.

WAIT TIMES

An additional fee of $20 per 15 minutes or $80 an hour, whichever is higher, will be billed to you if your driver is required to wait for you more than three minutes past your allocated pick-up time, for all un-scheduled stops, or for any scheduled stop that takes more than the agreed to time. Such fees will be billed to the credit card on file or may be required to be paid at the time of Service.

GROCERY, LIQUOR AND OTHER STORE STOPS

Grocery, liquor store, and other stops can be arranged on most trips if booked seven days prior to pick-up. PLEASE CALL FOR AVAILABILITY! Rates are $15 per 15 minutes or $60 per hour if booked in advance. The allocated time will be agreed to by you and the Company. To ensure that additional stops are available, please schedule such stops at least one month in advance.

CANCELATION POLICY

All cancellations must be made seven days prior to pick-up to receive a 100% refund with the exception of reservations made during the last two weeks of December, first week of January, March and April (“Holiday Trips”) which will require 30 days’ cancellation notice to receive a full refund.

All cancellations made between with more than four days’ notice but less than six days’ notice or Holiday Trips cancelled within 14 days of travel will receive a 50% refund. All cancellations made with less than three days’ notice or within one week for Holiday Trips will not receive a refund.

If you do not use the Services the day of (“No Show”), you will not receive a refund. AIRPORTS

All airport arrivals and departures will be picked up/dropped off based on the airport location. For all arrivals that are more than thirty minutes late, you may be required to rebook you departure for a later time.

Limitation of Liability; No Consequential Damages; Liability Limitation.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL OUR AGGREGATE LIABILITY UNDER THIS AGREEMENT EXCEED THE AMOUNTS ACTUALLY PAID OR OWED BY YOU FOR THE SERVICES GIVING RISE

TO LIABILITY UNDER THIS AGREEMENT. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL WE BE LIABLE TO ANYONE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES (INCLUDING, WITHOUT LIMITATION, LOST DATA, LOSS OF USE, LOST PROFITS, INCREASED COSTS, LOSS OF GOODWILL OR REPUTATION, OR BUSINESS INTERRUPTION) ARISING OUT OF, OR IN ANY WAY CONNECTED WITH THE SERVICES REGARDLESS OF CAUSE, EVEN IF WE HAVE BEEN PREVIOUSLY ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. YOU SPECIFICALLY AGREE AND ACKNOWLEDGE THAT THIS LIMITATION OF LIABILITY LIMITS OUR LIABILITY FOR DAMAGE TO YOU, YOUR LUGGAGE, OR FOR ANY DAMAGES CAUSED BY A DELAY OR INABILITY TO PROVIDE THE SERVICES.

Protecting Your Privacy

the Company makes all attempts to protect your private information. the Company will not share your personal information with any third parties without your consent unless otherwise stated in this Agreement. However, the Company does share your personal information with third parties that provide services to the Company, including, but not limited to, email marketing service providers, independent contractors that provide services to you through the Company, individuals with a professional requirement for confidentiality (CPAs, attorneys, financial planners), and Google Analytics, other analytical companies, and companies that provide services for the Site (for example, those that collect weblogs for the Company).

Third parties that you are referred to for services or people who post on our site may have different privacy practices. the Company is not responsible for, and does not have any control over, the privacy policies of those third parties, and encourages all users to read the privacy policies of each party you share information with.

Minors

the Company does not knowingly collect any information from persons under the age of 18 years of age.

Data the Company Collects and Usage

The Company may collect your personal information in any of our dealings with you. This may include your name, address, phone number, email address, and travel information. the Company sometimes collects your email address for purposes such as sending email newsletters and notifications about upcoming events and specials. By submitting your email to the Company, you consent to emails from the Company and emails sent on behalf of the Company by email marketing service providers on behalf of the Company.

the Company sometimes collects your cell phone number for the purpose of sending you text messages about the Company or calling you about services provided by the Company. By submitting your cell phone number to the Company, you consent to text messages from the Company and its text messaging service providers and to phone calls to your cell phone number. Please note for booked Services, a cell phone number may be required to ensure communication between you and your driver. the Company’s web logs collect standard web log entries for each page served, including, but not limited to, your IP address, page URL, and timestamp. Web logs help the Company diagnose problems with our server, to administer our site, and to otherwise provide the Company's products and service to you. In addition, the Companys may collect other information from your interaction with our Site, services, content, and advertising, including computer and connection information, statistics on page views, traffic to and from the Site, ad data, IP address, demographic and navigational data, and standard web log information. This information may be obtained for the Company from a third- party provider including, but not limited to, Google. the Company may use this information for marketing, commercial, or any other purpose as the Company sees fit.

the Company may collect your geographical location if your device allows it. This includes capturing such data through Google Analytics and other analytical programs. the Company uses your personal information for the purposes of its business. Some of the ways that the Company may use your personal information include:

• booking services;
• liaising with you regarding existing bookings and to secure future bookings;
• soliciting feedback from about your experience with the Company;
• internal and external training and marketing;
• engaging in once off or specific engagements – including research;
• publishing our marketing material;
• any other purpose that you have consented to; or
• for a purpose otherwise permitted by law.

If you apply for a job with or to be an independent contractor for the Company, the Company will hold, use and disclose that information solely for the purpose of considering your application. In particular, in considering your application, it may be necessary for the Company to disclose some of that information to third parties to verify the accuracy of that information. In such circumstances, the Company will disclose only such information as is necessary in the circumstances. In considering your application, the Company may also collect personal information about you from any third parties that you nominate as your referees in your application.

Data the Company Stores

All information posted and gathered by the Company in person, through the Site or any other means, including your personal information, is stored in the Company's database, even after "deletion”, and may be archived elsewhere.

the Company's web logs and other records are stored indefinitely. This may include any information you supply to the Company and your browsing history. However, the Company cannot guarantee access to these records by third parties for more than three business days after the original information was submitted.

Although the Company makes good faith efforts to store personal information in a secure operating environment that is not available to the public, the Company cannot guarantee complete security. While we also use security to secure the site, any information posted on your public the Company profile, including on social media sites, is made available to the public.

the Company may store information in an off-site location, which may or may not be located in the United States and may not be bound by the laws of the United States. Archiving and display of our webpages by search engines and other sites Search engines and other sites not affiliated with the Company - including Google.com, Bing.com, and Yahoo.com - archive or otherwise make available our Site. the Company has no control over third party archiving and search engine sites and cannot guarantee the accuracy of any information stored by search engine sites.

Circumstances in which the Company may release information the Company may disclose information about its users if required to do so by law or in the good faith belief that such disclosure is reasonably necessary to respond to subpoenas, court orders, or other legal process.

the Company may disclose information about its users to law enforcement officers or others, in the good faith belief that such disclosure is reasonably necessary to: enforce any agreement that you have entered into with the Company; respond to claims that anything you have done violates the rights of third parties; or protect the rights, property, or personal safety of the Company, its users, or the general public.

the Company may disclose your information to third parties for use by the Company. This may include disclosure to email marketing providers to provide targeted marketing for our users or other information to third party marketers. If you do not wish to receive email marketing from the Company, you will have the option to unsubscribe from the service.

the Company may disclose your information to other business entities should the Company plan to merge with or be acquired by that business entity.

the Company may disclose information to insurance companies, medical providers, and other individuals and companies should you have any accidents while using the Companys‘s Services.

International Users

the Company welcomes international users to browse the site. International Website Users consent to all the terms and conditions in this Agreement. International users waive any and all remedies that they may have based on the the laws of their country.
